OFFICIAL RULES for Febuary - May 2012

1. NO PURCHASE NECESSARY; A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING: Open to legal residents of the USA or Canada (excluding Quebec). Must be at least 18 years of age or the age of majority in your state/province of residence. Entrants must be physically located in the United States or Canada (excluding Quebec). Entrants must have Internet access and an email address by announcement date of sweepstakes. The sweepstakes begins on February 1, 2012 and will conclude on May 31, 2012. Void in PR and where prohibited.

2. TO ENTER: Members are automatically entered into this sweepstakes if they choose the option "Please enter me into the Jewelry Consumer Opinion Council’s Sweepstakes." This option is located at the bottom of the Survey. All online entries must be received by May 31, 2012 at 11:59 p.m. Pacific Time. A completed survey will enter you into the prize drawing. The random prize drawing will be held on or about June 7, 2012. All qualified entries received during the time period of this sweepstakes will be included in the drawing. Anyone giving false information on their entry will be eliminated. Limit of one prize per family or household. There is a limit of (1) one Grand Prize per person/email address within a 12 month period.

3. CONDITIONS: Sponsor assumes no responsibility for lost, late, misdirected, illegible, incorrect or inaccurate entry information whether caused by Web site visitors or by any of the equipment or programming associated with or utilized in the sweepstakes. Sponsor or any other releasee will not be responsible or liable for any website, computer, telephone, satellite, cable, network, internet or other equipment electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues. Sponsor reserves the right, in its sole discretion, to cancel or suspend this sweepstakes should a computer virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper operation of the sweepstakes. If the database of entrants becomes corrupted, the winner will be chosen from the remaining uncorrupted database of entrants. Any attempt by an individual to deliberately damage any Web site or undermine the legitimate operation of the game is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law. Use of any automated equipment to enter the sweepstakes will eliminate all entries from that person/email address. Entering more than once per survey by using multiple email addresses will eliminate all entries from that person/email address used.

4. PRIZES: There will be a total of 11 prizes given away. Grand Prize: One (1) Beautiful 1 carat total weight, 4 prong Diamond Stud Earrings set in 14kt Yellow Gold with friction backs to hold them firm. (ARV $1,100) First Prizes Ten (10): Great everyday diamond stud earrings with 4 prongs set in 14kt White Gold with .40 carat total weight of diamonds. Friction backs to hold firm. (ARV $450). Potential winners will be notified by email. Entrants are required to respond with a complete notification email giving their complete and valid name address, age and place of employment within 5 Days of notification date on the email or an alternate winner will be selected. Confirmed winners will receive notification of information received. Winners are encouraged to keep the confirmation for their records until prize is received. After the email response is received from the Grand Prize winner an Affidavit will be sent to the potential winner, which must be completed, notarized and returned within 14 days or an alternate winner will be selected. All applicable taxes are the responsibility of the winner. The affidavit will require the Grand Prize winner to give their Social Security number. All information provided will be kept strictly confidential and used to complete a 1099 Form for tax purposes. Prize will be awarded upon receipt of affidavit, and verification of prize winner. Prize is not transferable. No prize substitutions except at the discretion of the sponsor with an equal or greater value. Odds of winning based on the number of entries received. Drawing will be conducted by Innovative Processing, Inc., an independent judging agency whose decisions are final and binding on all matters relating to this sweepstakes. Prizes will be distributed within 6-8 weeks from confirmation of winning received.

5. CONDITIONS OF ENTRY: Employees of MVI Marketing LTD., sponsors, its agencies, distributors, subsidiaries, advertising and promotion agencies and affiliated companies, participating advertisers and media, employees, their immediate family members and/or those living in the same household of each are not eligible. Immediate family member is defined as husband, wife, children, mother, father, sister, sister in-law, brother or brother in-law. All federal, state and local taxes are the sole responsibility of the winner. All federal, state and local laws apply. Entry into this promotion constitutes permission to the Sponsor and their agencies to use winners' name, address and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. Sponsor reserve the right to substitute prize of equal or greater value. By participating, you accept and agree to abide by the Official Rules and all decisions of Sponsor and its judging and administration organizations, which are final and legally binding in all respects. Entrant recognizes and agrees that survey information will be made available only to Sponsor. By entering the sweepstakes, you hereby agree that in no event will sponsor or any other judging or administration organizations be responsible or liable for, and you hereby release them from, any and all claims, actions, damages, losses, costs or expense or liability of any kind arising or resulting from anything relating to this sweepstakes.

6. WINNERS LIST: The names of the prizewinners can be found by sending a self-addressed stamped envelope to: February-May Jewelry Consumer Opinion Council Sweepstakes, PO Box 240, Clear Lake, MN 55319. Requests must be received by June 29, 2012.

7. DISPUTE RESOLUTION: Entrant agrees that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) and Sponsor and their agencies, shall be governed by and construed exclusively in accordance with the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Minnesota. Entrant agrees that any action at law or in equity arising out of or relating to this sweepstakes, or awarding of the prize, shall be filed only in the state or federal courts located in the County of Stearns in the State of Minnesota. Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this sweepstakes, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
